1. Agreement to Terms

By accessing or using the VisitPerks website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Use License

Permission is granted to temporarily use VisitPerks for personal or commercial business purposes (as a Merchant). This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the software underlying the platform;
• Use the platform for any illegal purpose or in violation of any laws;
• Attempt to reverse engineer any software contained on the website;
• Remove any copyright or other proprietary notations from the materials.

3. Account Responsibilities

As a Merchant, you are responsible for maintaining the confidentiality of your login credentials and the Staff Access Code provided by our system. You agree to accept responsibility for all activities that occur under your account or via your Staff Access Code.

You are responsible for ensuring that your customers' data (specifically email addresses) is collected and used in compliance with applicable data protection laws (including our Privacy Policy).

4. Service Availability

We strive for 100% uptime but cannot guarantee that the service will be uninterrupted or error-free. We reserve the right to modify or discontinue the service at any time without notice. We shall not be liable to you or any third-party for any modification, suspension, or discontinuance of the service.

5. User Content & Rewards

You are solely responsible for the rewards you offer through the platform. VisitPerks does not fulfill rewards or guarantee the quality of goods/services offered by Merchants to End Users.

We reserve the right to remove any content or suspend accounts that violate these terms, including fraudulent redemption activity or spamming.

6. Limitation of Liability

VisitPerks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

8. Governing Law

These terms shall be governed and construed in accordance with the laws applicable in the jurisdiction where the company operates, without regard to its conflict of law provisions.
